INTRODUCTION


These terms and conditions apply to all our services provided by GrootTravels (“us”, “we”) made available online via the website, through any mobile device, by email or by telephone. As we always develop our services to meet the needs of our users (i.e. visitors of our website), we may amend these terms and conditions from time to time.  By  visiting, browsing and using our website or any of our applications through any device or platform as well as by completing a booking with our company, Users (“you”, “your”) acknowledge and agree to have read, understood and agreed to the below terms and conditions (including the privacy and cookies policy: https://www.groottravels.com/privacy-cookie-statement/ 


We provide online services for personal (B2C) use only. These services are subjected to the below terms and conditions. The relationship that we have with the wheelchair-adapted accommodations (together “ affiliate Partners”) are governed by separate terms and conditions which govern the (B2B) commercial relationship we have with each of these Partners. Each Partner acts in a professional manner with us when making its product and/or service available on or through our website. In addition to our Terms and conditions, please note that Partners may require acceptance of their own policies/terms and conditions on their website to access the stay, the accommodation and the booking process.


Article 1 – Applicability 


1.1. Our company legally constituted under the laws of the Netherlands, registered in the trade register of the Chamber of Commerce under number 73177237 located at Wibautstraat 131D in 1091 GL Amsterdam , the Netherlands. 


1.2. These terms and conditions apply to every offer of- or agreement with GrootTravels in relation to its services. These terms and conditions also apply for the benefit of everyone who works (and worked) at GrootTravels as well as any person engaged by GrootTravels, including all persons for whose acts or omissions GrootTravels is or may be liable.





Article 2 – GrootTravels’ services


2.2. We provide intermediate services related to travel for international visitors with physical disabilities and their family members. GrootTravels is not a travel agent and it does not provide travel agency services. GrootTravels is not a tour operator and it does not offer package trips. 


2.3. Through our website, we (GrootTravels. and its affiliate partners) provide an online platform through which wheelchair-adapted accommodations can promote, advertise, sell and/or offer (as applicable) their products and services for purchase, booking, order, or rent. Through affiliate partners relevant visitors can search, compare, make a booking, purchase or payment. 


2.3. By using or utilising the affiliate service (i.e. by making a booking through an affiliate Partner website), you enter into a direct (legally binding) contractual relationship with the affiliate Partner (e.g. hotel) with which you purchase or book a product or service (as applicable). From the point at which you make your booking, we act only as an intermediary between you and the affiliate Partner (e.g. wheelchair adapted accommodation), advertising the relevant offers of affiliates. The affiliate Partner will be sending you the relevant details of the booking and a confirmation email for and on behalf of themselves. GrootTravels does not (re)offer, rent, or offer any (travel) product or service.


2.4. When visiting our service, the information that we disclose is based on the information provided to us by affiliate Partners. As such, the affiliate Partners who promote their accommodation on our website are granted access to our systems and extranet through which they are fully in charge for updating all prices/rates/fees, terms & conditions, policies, availability and any other relevant information which is displayed on our website. 


2.5. As our services are made available for personal and non-commercial use only, you shall not to re-offer, copy, use, display or reproduce any content, information, bookings, products or services available on our website for any commercial purpose.


2.6. Our company is entitled to terminate its relationship with affiliate Partners for any reason (including but not limited to the breach of their agreement) with a reasonable notice period. 




Article 3 – Users


3.1. Our obligation to provide services consists of best efforts to provide information. As a user, you are obliged to inform us of all facts and circumstances that may be relevant for the correct performance by us of our services as well as all data and information required by us.


3.2. Users must provide all data or information required by us. Users shall indemnify us against all claims and actions, of any nature, brought by third-parties against our company.


3.3. Users are under the obligation to declare anything that may impede the performance of our services. Failure to do so may result in GrootTravels and its affiliates partners refusing users access to services contracted due to, among others, safety and health concerns and/or the well-being of others.


Article 4 – Travel documentation and insurance


4.1.  Users are solely responsible for being in the possession of valid identity documents (identity card, passport, visa), vaccination and other medical certifications, as well as any required documents to comply with affiliate Partners offers.


4.2. Users are required to make arrangements for adequate insurance. Please consider having a comprehensive insurance for travel, medical expenses, booking accommodation, etc. Users acknowledge that they are responsible to arrange their own insurance. It is the responsibility of users to ensure that their personal caregiver are registered with an association for the disabled in their own country and are complying with these terms and conditions. 


Article 5 – Prices, payment and Partner offer 


5.1. All prices/rates/fees for wheelchair adapted accommodation are displayed on our affiliate Partners. Applicable taxes and/or fees (including tourist or city tax) may be charged by the accommodation provider in the event of cancellation or a no-show. Please check the relevant product, service and booking conditions and details carefully before making your reservation.


5.2. If we advertise prices, these prices will be for information purposes only and should not be relied upon. We may display special offers and promotions. You shall not derive any rights from these offers. Please check the price and validity of special offers with the affiliate Partner.


5.3. GrootTravels website displays affiliate Partners offers that are directly sourced from accommodation Providers (Partner offer). Requests shall be made directly with the wheelchair adapted accommodation/property.


Article 6 – GrootTravels: Free of charge services, only pay our Partners


6.1. Our service is free of charge for users. You shall pay the accommodation Provider the relevant amount as stated in your reservation on the Partner affiliate website. 

6.2. Accommodation providers pay us a commission (small percentage of) on the price that you pay for the service or product that you consume. Preferred partners pay a higher commission in return for a better visibility on our website. 


6.3. Our company advertise offers from accommodation providers with which we have a commercial relationship (B2B). We do not advertise the products or services of non-professionals. We DO NOT provide the possibility for end users to make their product or service on our website. 


Article 7 – Communication with our Partners


7.1. You shall complete an accommodation reservation on our affiliate Partners website. Our affiliate Partners are responsible to send any information on the accommodation and providing you with your stay. 


7.2. Our company shall not liable or responsible for any communication by or with the accommodation Provider on or through their website. You cannot claim the benefit any rights to us from any communication with the accommodation Provider or (any form of) acknowledgement of receipt of any further communication with the Provider. We cannot guarantee that any request or communication will be (duly and timely) received, executed or accepted by the accommodation Provider.


7.3. In order to receive our offers, you need to add your correct phone number and email address when required.






Article 8 – Cancellation of a service 


8.1. Please check the (reservation) details of the product or service of your choice carefully before making your reservation.


8.2. Should you wish to cancel your booking, you must do so according the terms and conditions of the affiliate Partner with whom you have made a reservation.


8.3. By making a reservation with an accommodation Provider, you accept and agree to the no-show policy and cancellation of that accommodation Provider, and to any terms and conditions of the accommodation Provider applies to your booking. The relevant terms and conditions of the accommodation Provider can be obtained with the relevant accommodation Provider. 


Article 9 – Impediment to provide services


9.1. We shall not be liable for not performing our services due to circumstances beyond our control. We are not under any obligation to provide an alternative.


9.2. When a user mandates another person to use our services on user’s behalf, we are not liable for any losses or damages incurred including but not limited to payments made for user booking of our affiliate Partner’s accommodations.


9.3. We are entitled to suspend our advertising services in case of force majeure, such as natural disaster, war, strike, government action, accidents and technical defaults.


Article 10 – Users reviews


10.1. Our website display reviews of the accommodation of our affiliate Partners. The user will decide of the rating according to criteria such as accessibility and its overall satisfaction.


10.2. Our website allows users and scout to score their customer experience with stars and commented reviews. Only users who have been customers (who have stayed at) of the accommodation displayed on our website can leave a guest reviews on our website.  Our website does also allow to upload images to illustrate customer experience.


10.3. Scouts (i.e. knowledgeable users or customers who have a real experience of the accommodation. see below Article 17) are also allowed to share on the website their opinion of the accommodation they recommend. 


10.4. Any type of review will be thoroughly read and approved by us before being published. We will not accept reviews including: (i) discrimination on gender/race/religion and any other individual human characteristic, threats, hate speech, sexually explicit comment, violence (ii) insults, mention of full names or personal details of individuals, attacks towards our staff, agents, scouts or partners (ii) the promotion of illegal activities, (iv) any other comment that will be deemed inappropriate by our company.


Article 11 – Intellectual property


11.1. Our company own the intellectual property rights (including the copyrights) of all contents, information and material on our website and social media.


11.2. You shall not copy, scrape, publish, market, (re)sell, integrate, use, combine or otherwise use the content of our brand without our permission in writing. When leaving a review on our website, you hereby assign, transfer such intellectual property rights to GrootTravels. 


11.3. Any unlawful use of our brand or unapproved behaviour will constitute a material violation of our intellectual property rights (including copyright and database right) and therefore could lead to appropriate legal actions.


Article 12 – Complaints 


12.1. Any complaints, requests or claims in respect of the accommodation Service must be submitted to the accommodation Provider. In this regard, please see visit the affiliate Partner website.


12.2. Any complaints, requests or claims in respect of our services (i.e. advertising/ promotion) must be promptly submitted to our customer service (customerservice@groottravels.com). Any claim, request or complaint will is answered within 14 days following the da of sending.






Article 13 – Liability 


13.1. We are not liable for users not providing pre-booking information regarding access problems that might limit enjoyment of the wheelchair adapted accommodations booked.


13.2. We are not liable for any property damage, bodily injury or financial loss linked to the offers of our affiliate Partners. We are not liable for any additional costs or expenses users may have due to circumstances beyond our control.


13.3. Our liability is excluded for damage or loss as a result of the inaccessibility of our website or the websites of our affiliate Partners, as well as for loss or damage as a result of technical defect. We are not liable for breach in the performance of our affiliate Partner services.


13.5. To the extent permitted by the applicable law (see Article 14), we do not guarantee the accuracy of any information contained on our website. We dismiss any responsibility for fault, errors or omission in the information and/or products or services provided by our affiliate Partners. We do guarantee that our website is free from viruses or anything harmful any technology at all times.


13.6. We do not endorse our accept any responsibility for a link to another website or the content or use of such website.


13.7. When users visit or leave reviews on our website, they agree to give us permission to use their information for marketing purposes (in conformity with our privacy policy: https://www.groottravels.com/privacy-cookie-statement/ , without any financial remuneration being due to users.


13.8. Our liability is limited to direct damage or loss resulting from our own services.


Article 14 – Applicable law and disputes


All agreements, relations and services between our company and users are governed by and shall be construed according to the laws of the Netherlands.


Should any dispute exist between us and any user, the dispute shall be settled in accordance with the Arbitration Rules of the Netherlands Arbitration Institute. 

  • The arbitral tribunal shall be composed of one arbitrator
  • The PARTIES shall agree on the appointment of the arbitrator. Should the PARTIES disagree on the appointment. The arbitral tribunal shall be appointed according to the list procedure
  • The place of arbitration shall be in Amsterdam
  • The proceedings shall be conducted in English
  • The arbitral tribunal shall decide as amiable compositor
  • Consolidation of the arbitral proceedings with other arbitral proceedings, as provided for in Article 1046 of the Dutch Code of Civil Procedure and Article 39 of the Arbitration Rules of the Netherlands Arbitration Institute, is excluded.


Article 15 – Modifications of the Terms and conditions


We are entitled to modify these terms and conditions at all times. Please check the most up-to-date version of these terms and conditions available here through GrootTravels’ website.


Article 16 – Disclaimer 


16.1. Any information, data or statement made on our website in images, written comments, offers, advertising material is not binding on our company, except if we state otherwise.


16.2. We do neither guarantee nor verify if all information on our website is accurate, or complete. We are not responsible for (i) any errors (e.g. typographical errors), (ii) any interruptions breakdown, or maintenance of our website, (iii) any inaccurate, or misleading information provided by affiliate Partners. Each Partner remains responsible at all times for the completeness, the accuracy and correctness of the information (including the prices/rates/fees, policies, terms & conditions and availability) displayed on our website. Our website is neither a recommendation nor an endorsement of the rating, quality, qualification or service level of the type of accommodation (venue, facilities, products or services) made available by our affiliate Partners.


16.3. Our Company is not liable for the choice or any shortcomings of our affiliate Partners. The applicability of Section 6:76 of the Dutch Civil Code is excluded in its entirety.


16.4. If any provision of an agreement or any other agreement conflicts with any of the provisions of our terms and conditions, the provisions of our terms and conditions prevail. 


Article 17 – Supporting us and scouting 


17.1. Our company is supported by various affiliated companies and scouts. 


17.2. The affiliated companies promote and market their wheelchair adapted accommodation services on our website. If you choose to use the service of an affiliate, you do have a (legal or contractual) relationship with the affiliate. All Wheelchair adapted accommodations displayed on our website will be approved us and will receive an e-mail confirmation of the affiliate program they apply for (info: sonia@groottravels.com)
